Terms of Service

Welcome to ActionStream ("Company", "we", "our", "us"). By accessing or using the ActionStream platform at actionstream.press (the "Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

The Service provides access to a library of editorial photographs licensed for press, media, and private use under editorial license terms as described herein.

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account. We cannot and will not be liable for any loss or damage arising from your failure to comply with this obligation.

We reserve the right to terminate accounts that violate these Terms or that have been inactive for more than 24 months.

Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal or professional editorial purposes.

Single-image purchases and subscription downloads are licensed under editorial license terms described in our Licensing Policy. Each license is granted to the purchasing user only and may not be transferred.

You agree not to:

• Use images for commercial advertising, product packaging, or promotional materials
• Resell, sublicense, or redistribute downloaded images or access credentials
• Use images in a manner that implies endorsement by the depicted person or organization
• Attempt to circumvent any technical measures protecting the Service
• Upload content that infringes third-party intellectual property rights
• Use the Service for any unlawful purpose

All photographs available on the Service are protected by copyright. Photographers retain copyright over their images. ActionStream holds an exclusive distribution license for the images hosted on the platform.

The ActionStream platform, including its design, software, and branding, is the exclusive property of ActionStream sp. z o.o. and is protected by applicable intellectual property laws.

All prices are listed in the applicable currency and exclude VAT unless stated otherwise. VAT is applied at checkout based on your billing country.

Subscription packages are pre-paid and non-refundable. Credits (download allowances) expire at the end of the subscription period and do not roll over.

We reserve the right to change pricing at any time. Changes to subscription pricing will be communicated at least 30 days in advance.

You may cancel a subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a subscription period.

One-time image purchases are final and non-refundable once the download has been accessed.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by applicable law, ActionStream sp. z o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with these Terms or your use of the Service.

Our total liability to you shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by email or by posting a prominent notice on the Service. Continued use of the Service after such notice constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of Poland. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Warsaw, Poland.
